Maintain a design
The exclusive right to a design exists once the BOIP has registered your application. In contrast to trademarks law, a design does not have to be used in order for the design right to be maintained. Of course you do have to renew your design registration in good time and keep it up-to-date.
“I developed the Tuliplu, also known as the tulip umbrella, in 1990. The model was registered in those countries where we saw the best markets. To prevent it being copied, I have the umbrella’s characteristic handle, shaped like a tulip’s calyx, attached in the Netherlands. The rest of it is produced overseas. I’ve already applied for and secured around six interim injunctions."
