Is my trademark still available?
There are various ways to check whether a trademark already exists.

If my trademark is available, can I register it?
The Benelux Office for Intellectual Property (BOIP) has the authority to reject a trademark if it is already in the register. Trademark owners have to take action themselves if their rights have been violated. They can do so by filing an opposition. The BOIP does have the authority to refuse  a trademark if it does not meet the suitability requirements of a trademark, because it is not distinctive, or it is descriptive or misleading, for instance.

Where can I view the status of my trademark?
You can follow the progress of your application in the Trademarks Register. You will not be notified of a change of status.


I received a letter about renewal. What should I do now?
You can renew (extend) your trademark registration online via the BOIP portal. To log in to the BOIP portal, you must first create an account.

How much does it cost to extend a trademark to apply internationally?
The cost of an international extension depends on several factors, including the number of classes, the countries in which the extension will apply and whether it is a colour trademark. Click here to calculate the cost of your extension. The WIPO  in Switzerland is responsible for international registrations. This is why the costs are also displayed in Swiss francs.
