Maintain a trademark

The exclusive right to a trademark exists once the BOIP has registered your application. Your trademark will be published in the official Benelux Trademarks Register.You will receive a certificate of registration. Once your trademark is registered you can take action against infringements (counterfeiting and piracy).

You can take action not only against subsequent Benelux trademarks, but also against all trademarks valid in the Benelux territory, i.e. including EU trademarks and International trademarks that are valid in the Benelux territory.

In order to maintain this exclusive right you must use it, monitor it, keep it up-to-date and renew your registration in good time.

Fledgling companies in the creative sector tend to start with little or no means, but I always point out that brand registration is a good investment.
