Renewing your trademark in 5 steps

You’ve protected your trademark, and of course you don’t want to allow that protection to run out, so you have to keep in mind when your trademark has to be renewed. A Benelux trademark registration is valid for ten years. After that, you need to look at it again. How does renewal work? What is possible and what is not, when you renew? How can you renew your trademark? 

You can renew your trademark in 5 steps: 

  1. Log in to MyBOIP. Or first open an account if you don’t have one yet. Your trademark does not have to be linked to your account to renew it.
  2. In the Trademarks column, click on ‘Renew a trademark registration’. 
  3. Enter your trademark registration number. You will then see an overview. 

    Do you need help to find your registration number? In the BOIP Trademarks Register enter the name of your trademark and click on “More details” to go to your trademark page. You will find the trademark registration number on this page. 
     
  4. Click on ‘Renew trademark’ (below right). Do you want to renew the trademark for only some of the classes? Then click on ‘Renew trademark partially’ and select the classes you wish to renew. 
  5. Finally, click on ‘Pay’. After you have paid, your registration is valid for another ten years! Don’t forget to mark the new date of expiration in your business agenda! 

How much does renewal cost? 
On the Fees page you can read how much it costs to renew your trademark. The costs depend on how many classes your trademark covers and how many classes you want to renew your trademark for.  

What can you do if your trademark or your activities have changed? 

You can never change a trademark yourself; that is also the case when you renew. If your trademark is changed, it then becomes a new trademark, for which you have to apply for a new trademark registration. If, over the past ten years, your products or services have changed, then you may decide either to choose fewer classes (via the ‘Renew a trademark registration’ button, see above), or to eliminate a number of products or services from a particular class. You cannot add any new products or services; for that, you have to apply to register a new trademark.

Renew your trademark every ten years 

A Benelux trademark registration is valid for ten years from the date on which you filed the application. After that, you can renew your trademark for ten years – every ten years, indefinitely. Renewal is possible from six months before the date of expiration. After the date of expiration has passed, you can still renew within six months but you will then pay an additional fee. Once the six-month period after the date of expiration has passed, you can no longer renew your trademark: your trademark has then expired and you will have to apply for a new trademark registration. That is why it is important to renew on time! We will send you a reminder in any case, but it is a good idea to also note the date of expiration in your business agenda.
